Section 1: Reservation & Pre-Order Policy

1.1 Deposit and Reservation Allocation

By placing a reservation for the Hero Keyboard, you agree to a $50.00 USD refundable deposit. This deposit secures your position in the production queue.

1.2 Balance Billing and Authorization

Prior to the fulfillment and dispatch of your order, Hero Devices Inc. will send an automated notification to your registered email address outlining the impending final charge. You authorize Hero Devices Inc. or its third-party payment processors to automatically charge your saved payment method for the remaining balance of the dispatched item/s including all applicable taxes and shipping fees.

1.3 Order Cancellation and Refund

Reservations may be canceled by the customer at any time prior to the generation of a final shipping tracking number. Upon cancellation, the $50.00 USD deposit will be refunded in full to the original payment method within five (5) to ten (10) business days.

1.4 FTC Mail, Internet, or Telephone Order Rule Compliance

Hero Devices Inc. commits to providing accurate shipping estimates. If an unforeseen manufacturing or logistical delay causes the shipping date to extend beyond the initial estimate provided at checkout, we will notify you immediately in writing. You will be provided the explicit option to consent to the delay or cancel your order for an immediate, full refund.

Section 2: Return & Refund Policy

2.1 30-Day Return Window

Customers may initiate a return for a refund within thirty (30) calendar days from the date the carrier verifies delivery of the Hero Keyboard.

2.2 Condition of Returned Goods

To qualify for a full refund, the hardware must be returned in strictly new condition. It must be free from physical damage, liquid damage, cosmetic wear, or internal modifications. The return must include the original chassis, all cables, adapters, original packaging, and documentation.

2.3 Return Shipping Liabilities

The customer is solely responsible for all return shipping costs. Hero Devices Inc. strictly recommends utilizing a trackable shipping service with full transit insurance. Hero Devices Inc. assumes no liability for returned merchandise damaged or lost in transit to our facility. Original outbound shipping charges are non-refundable.

2.4 Inspection and Restocking Fees

All returns are subject to a mandatory hardware inspection upon receipt. Units demonstrating customer-induced damage, missing components, or signs of use beyond basic initial testing will be subject to a restocking fee commensurate with the diminished value, or the return may be rejected entirely and shipped back at the customer's expense. Approved refunds are processed to the original payment method within five (5) to ten (10) business days following inspection.

Section 3: 3-Year Limited Hardware Warranty

3.1 Warranty Scope and Duration

Hero Devices Inc. warrants the Hero Keyboard hardware against defects in materials and workmanship under normal, intended use for a period of three (3) years from the original date of delivery. This includes the Core Ultra computing hardware, internal architecture, battery, wireless modules, mechanical switches, and chassis integrity.

3.2 Claim Requirements

To initiate a warranty claim, the original purchaser must contact support and provide:

• The original Order Number or Proof of Purchase.
• The unique Hardware Serial Number.
• Clear documentation (written and visual) of the hardware failure.

3.3 Warranty Exclusions

This warranty explicitly does not cover:

• Accidental damage, including drops, liquid spills, thermal damage, or electrical surges.
• Cosmetic wear and tear, including keycap wear, anodization fading, or scratches.
• Damage resulting from unauthorized disassembly, hardware modification, or third-party repairs.
• Failures related to third-party software, operating system modifications, or non-Hero Devices external accessories.

3.4 Remedies

If a valid claim is verified via our Return Merchandise Authorization (RMA) process, Hero Devices Inc. will, at its sole discretion: (a) repair the hardware using new or refurbished OEM parts; (b) replace the unit with a functionally equivalent reconditioned product; or (c) refund the original purchase price.

Section 4: Shipping, Customs & Export Policy

4.1 Cross-Border Shipments to Canada (DDU)

All orders shipped to Canada are shipped Delivery Duty Unpaid (DDU). The prices displayed on the website do not include Canadian federal or provincial sales taxes (GST/HST/PST), customs duties, or carrier brokerage fees. The customer acts as the Importer of Record and is strictly responsible for remitting all applicable import fees to local customs authorities or the designated carrier upon delivery.

4.2 Export Controls (EAR Compliance)

The Hero Keyboard contains integrated computing and encryption technology subject to the US Export Administration Regulations (EAR). By purchasing this product, you represent and warrant that you will not export, re-export, or transfer the hardware to any embargoed nations or prohibited end-users as defined by the United States government.

Section 5: Terms of Service & Legal Framework

5.1 Intellectual Property Rights

All mechanical designs, unibody architectures, firmware protocols, source code, domain assets, logos, and website copy are the exclusive property of Hero Devices Inc. Reverse engineering or unauthorized commercial reproduction is strictly prohibited.

5.2 Limitation of Liability

To the maximum extent permitted by applicable law, Hero Devices Inc., its directors, and manufacturing partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or business interruption arising from the use or inability to use our hardware.

5.3 California Proposition 65

WARNING: The internal electronic components of this product may expose you to chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm.

5.4 Dispute Resolution, Arbitration, and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, USA. Any dispute, claim, or controversy arising out of your purchase or use of the Hero Keyboard shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA). You expressly waive any right to bring or participate in a class-action lawsuit or class-wide arbitration.

Section 6: Privacy Policy & Data Protection

6.1 Data Collection

We collect required Personally Identifiable Information (PII) strictly to fulfill hardware orders, manage the reservation queue, and provide customer support. This includes name, shipping/billing address, and email. Payment details are processed securely via third-party PCI-compliant gateways; Hero Devices Inc. does not store full credit card numbers on its servers.

6.2 Cookie Compliance and Tracking

In compliance with US State Privacy Laws (e.g., CCPA/CPRA) and Canadian regulations, we utilize consent management tools to control non-essential tracking cookies. Visitors may explicitly grant or deny permission for analytics and advertising trackers upon their first visit to the site.

6.3 User Rights (CCPA, PIPEDA, Law 25)

Users maintain the right to request access to, correction of, or permanent deletion of their personal data. Canadian residents are advised that their data may be stored on servers located in the United States and subject to US legal jurisdiction. Privacy requests may be submitted directly to our compliance team.

Section 7: Communications & Anti-Spam (CASL/CAN-SPAM)

7.1 Transactional vs. Commercial Communications

By providing your email address, you consent to receive critical transactional emails regarding your order status, reservation billing, and hardware safety notices.

7.2 Email Marketing Compliance

Hero Devices Inc. operates in strict compliance with the US CAN-SPAM Act and the Canadian Anti-Spam Legislation (CASL):

• Opt-In Requirement: We will only send commercial electronic messages (CEMs) or marketing promotions to users who have provided explicit, affirmative consent (opt-in). We do not use pre-checked boxes for marketing communications.
• Right to Unsubscribe: Every commercial email contains a clear, one-click unsubscribe link. Opt-out requests are processed permanently within ten (10) business days.
• Sender Identification: All promotional emails will clearly identify Hero Devices Inc. as the sender and include our valid physical mailing address: Hero Devices Inc., 29 Louisburg Sq, Lakewood, New Jersey, USA.
